Imo Deputy Governor’s Impeachment: Court Reserves Date For Ruling

Justice Benjamin Iheaka of Owerri High Court has reserved date for judgment in a matter bordering on the impeachment of the State Deputy Governor, Prince Eze Madumere.

Madumere was impeached by the Imo State House of Assembly, a process he is challenging in court.

The House had cited gross misconduct on his part which gave rise for his impeachment.

During legal cross fire, Counsel to Madumere, Ken Njemanze (SAN) argued that the process of the impeachment of the erstwhile Deputy Governor breached constitutional guidelines to warrant a court quashing and stopping the process.

He said for the process to be in order, there must be constitutional procedures, stating that when there are such breaches, the Court can halt it and both parties involved can approach the Court for protection.

Lawyers to the defendants (Imo State Government) argued that the High Court lacks jurisdiction in the matter because a section of the Constitution 128 sub section 5 states that when an impeachment process begins, no court can stop it.

The presiding judge, Justice Iheaka told both parties to go and wait to be communicated on a new date for ruling.
