It was jubilation galore in Ekwereazu autonomous community in Ahiazu LGA of Imo state as the High Court of Imo state in the Mbaise Judicial Division, holden at Ahiazu mbaise and before His Lordship, Hon. Justice. I.M. Njaka, upheld and confirmed Mr Kenneth Chukwuma Anosike the authentic President General of Ekwereazu Town Development Union (ETDU).

Ruling in suit no.HAM/84/2021 between Mr Kenneth Chukwuma Anosike- Plaintiff and President General of Ekwereazu Town Development Union versus HRH, Eze Barr. P.N. Anosike, Chibuike Uzogara, UBA Defendants- filed on October 27, 2021, the presiding Judge, Hon. Justice I.M. Njaka, granted all the reliefs sought by the plaintiff and declared as follows: That the first defendant (HRH Eze P.N. Anosike) has no power under the constitution of Ekwereazu Town autonomous community, Ahiazu Mbaise and the extant laws to interfere with the control, management, structure and general administration of Ekwereazu Town Development Union.

That the notice of suspension dated 04/09/2021 authored by the 1st defendant, Chief Sir John Anosike (palace chairman) and Chief Peter E. Obasi (Palace Secretary) for the Eze-in-Council Ekwereazu community is irregular, ultra vires the powers of the 1st defendant, null, void and of no effect whatsoever.

That the running/operating of the community account of Ekwereazu community in the 3rd defendant (UBA) by the 1st defendant contrary to the provisions of the constitution of Ekwereazu community is irregular, ultra vires the powers of the 1st defendant, null, void and of no effect whatsoever.

Saying an order is made as court set aside the notice of suspension dated 04/09/2021 authored by the 1st defendant, Chief Sir John Anosike (Palace Chairman) and Chief Peter E. Obasi (Palace Secretary) for the Eze-in-Council Ekwereazu community in Ahiazu Mbaise LGA and served on the plaintiff.

The court added that an order of perpetual injunction was also made restraining: the 1st defendant from interfering with the control, management, structure and general administration of Ekwereazu Town Development Union, the 2nd defendant (Chibuike Uzogara) from parading himself as the President General or acting President General of Ekwereazu Town Development Union.

Stating that it restrained the 1st defendant from withdrawing or otherwise howsoever accessing the funds of Ekwereazu Town autonomous community’s account contrary to the provisions of the constitution of Ekwereazu Town autonomous community, Ahiazu mbaise, the third defendant from releasing the said funds to the 1st defendant contrary to the provisions of the constitution of Ekwereazu Town autonomous community Ahiazu mbaise, Imo state.

Speaking to our reporter on the landmark judgement, the President General of Ekwereazu Town autonomous community, Mr. Kenneth Chukwuma Anosike described the judgment as a victory for the people of Ekwereazu Town autonomous community, adding that it would definitely mark a new beginning towards the development of his community.

He called on all sons and daughters of his community to see the court judgment as a call towards peace, unity and focus on the progress of their community.
