Justice Inyang Ekwo of the Federal High Court in Abuja has rejected Senator Samuel Anyanwu’s request to restrain the Independent National Electoral Commission (INEC) from recognizing his removal as the National Secretary of the Peoples Democratic Party (PDP).
Instead, the judge ordered Anyanwu to notify INEC and other defendants of the suit and appear in court for a hearing.
Anyanwu, through his counsel, K.C.O. Njemanze (SAN), filed an ex-parte application on Wednesday, seeking an order to prevent INEC from receiving or acting on any correspondence from the PDP unless signed by him.
He also sought to restrain Ambassador Umar Illiya Damagun from submitting documents or correspondence to INEC without his signature.
Justice Ekwo, while acknowledging the urgency of the matter, declined to grant the restraining order ex-parte.
He ruled that hearing from the defendants was necessary before issuing any directive.
The court instructed Anyanwu to serve the court processes on INEC and Damagun and scheduled the case for hearing on February 24.
