Fidelity Bank Plc has responded to GON-SETEC Nigeria Limited’s claims over a disputed sewage treatment project, rejecting allegations of wrongful contract termination while inviting the engineering firm to a meeting aimed at resolving the dispute.
The development follows a July 20, 2026 demand letter by GON-SETEC, in which the company accused the bank of wrongful termination of its engagement and demanded payment of professional fees, damages for breach of contract, unjust enrichment and loss of business opportunity. INNONEWS had earlier reported GON-SETEC’s position and its threat of legal action over the disputed engagement.
The bank’s response, dated August 10, 2026, was addressed to Chief Kola Kuforiji of Kola Kuforiji Law Office and signed by Oluwatodimu Adeyemi, Legal Services, and Adekunbolaji Siyonbola, GH, Litigation & Dispute Resolution.
Fidelity Bank rejected GON-SETEC’s claims, maintaining that there was no contract between the parties capable of being terminated. The bank said GON-SETEC’s engagement was limited to preliminary consultancy services and that no formal or informal contract for the deployment of a sewage treatment plant at its head office was awarded to the company.
The bank, however, acknowledged that GON-SETEC rendered certain consultancy services at its request. It said compensation for those services was never discussed or agreed, adding that any payment that may be due would have to be determined through mutual engagement based on the nature, scope and value of the services rendered.
On the disputed sewage treatment project, Fidelity Bank said it followed its procurement procedures by conducting a competitive tender, with GON-SETEC among several vendors invited to participate. The bank said GON-SETEC’s bid was unsuccessful after evaluation and that the eventual award to another firm was transparent and competitive.
Despite its rejection of the claims, Fidelity Bank said it remained committed to an amicable resolution and invited GON-SETEC to discuss compensation for the consultancy services rendered and, where appropriate, negotiate in good faith. The meeting is scheduled for Thursday, August 13, 2026, at 12 noon, at 2 Kofo Abayomi, Block B, Victoria Island, Lagos. GON-SETEC, while maintaining that Fidelity Bank breached its contract, has said it is not averse to a peaceful settlement of the dispute.
